Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AFFIRMS THAT THEY HAVE READ, UNDERSTOOD AND ACCEPTED THESE OFFICIAL RULES. WINNING A PRIZE IS CONTINGENT UPON FULFILLMENT OF ALL REQUIREMENTS SET FORTH HEREIN.

  1. Eligibility: Eligibility to participate in the School Specialty Makeover Sweeps (the “Promotion”) is limited to legal residents of the fifty (50) United States (including District of Columbia) who are at least eighteen (18) years old at the time of entry and eligibility to win prizes is further limited to: (i) for the school makeover prize and the professional development prizes, to pre-kindergarten (pre-K) through secondary educational institutions (“Schools” or “School” as further defined below); and (ii) for the gift card prizes, to individuals employed at a School (an “Educator”), to volunteers at a School (a “Volunteer”), and to parents/guardians of a student at a School (a “Parent”). Proof of age, eligibility (including status as an Educator, Volunteer or Parent), identity must be furnished upon request. Any effort by a participant to misrepresent himself or herself using aliases or multiple e-mail addresses will result in disqualification. Entries generated by a script, macro or other automated means are void. Entrants who disregard these official rules (the “Official Rules”) are not eligible to participate or win. Employees of School Specialty (“Sponsor”) and their parent and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible to win prizes or make entries. The Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited. Participation in the Promotion by making an entry, or accepting a prize, constitutes full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Promotion consists of a sweepstakes (the “Sweepstakes”) for one (1) grand prize and ten (10) secondary prizes. The prizes do not have a cash-out option.

  2. Sponsor: School Specialty, LLC., W6316 Design Drive, Greenville, WI 54942.

  3. Timing: The Promotion begins on April 15, 2024, at 12:00 a.m. Eastern Time ("ET") and ends on May 30th 2024 at 11:59 p.m. ET (the "Promotion Period"). Draw Date/Approximate Winner Notification Date 06/30/24.

  4. Definition of School: A School or School(s) means a permanent organization, (i) offering pre-K care or any level of kindergarten to secondary education, (ii) located and operated at an owned, or multi-year leased, physical property, that (iii) offers courses of instruction (or if Pre-K offers daycare) to a group of students (or if Pre-k children) who meet its enrollment criteria, and (iv) operates in compliance with the compulsory attendance laws of the States in which they are located (or if Pre-K, operates in compliance with the pre-K licensing laws of the States in which they are located), whether treated as public schools, private schools, or charter schools under State law. A School or School(s) does not mean: (i) virtual schools, (ii) home schools, (iii) post-secondary schools, or (iv) or any other educational organization which lacks permanent physical classrooms or does not employ educators who are subject to State or local government professional development requirements.

  5. How to Enter: To enter the Sweepstakes, go to schoolspecialty.com/school-makeover-sweepstakes during the Promotion Period and complete the entry form and follow all subsequent prompts and instructions (an “Entry” or “Entries”, the Educator, Volunteer or Parent individual making an Entry the “Entrant”). Entrant will be required to provide the information requested, including Entrant’s first and last name, e-mail address, their status as an Educator, Volunteer, or Parent, and the name of their associated School. All Entries must be received on or before the end of the Promotion Period to be eligible to win. Entries will be deemed to have been made when they are received and accepted by the Sponsors. The Promotion may also offer additional Entries to an Entrant during the Promotion Period via e-mail. Entrant may be able to “Refer a Friend” for an extra Entry. “Refer a Friend” recipient link is only valid the same week original Entrant entered and activated unless ended earlier by the ending of the Promotion Period. In the event of a dispute regarding the identity of a Promotion Entrant, the authorized account holder of the e-mail address used to make the Entry will be deemed to have made the Entry. “Authorized account holder” is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof of being the authorized account holder may be required. Entries that are incomplete, illegible, altered or tampered with or not submitted pursuant to these Official Rules are not eligible to win. Proof of being the authorized account holder may be required.

    The above methods of entry are not required to enter the Sweepstakes. In addition, Entrants may enter the Sweepstakes by using the following alternate means of entry (AMOE): Entrants may receive one (1) entry by legibly printing the Entrant's name, street address, city, province/state, postal code, telephone number, their status as an Educator, Volunteer, or Parent, and the name of their associated School, and the name of this Sweepstakes, on a 3 x 5 inch (or 7.5 x 12.5 cm) piece of paper and mailing it to School Specialty Makeover Sweepstakes, School Specialty, W6316 Design Drive, Greenville WI 54942 which must be received within the Promotion Period, and is subject to all the rules and eligibility requirements of these Official Rules. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

    Any attempted entries received after the close of the Promotion Period, or which are not in compliance with these Official Rules, will not be accepted. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different identities, email addresses, registrations and logins, or any other methods will subject the participant to disqualification from the Promotion, in Sponsor’s sole and absolute discretion. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the participant. The "authorized account holder" is the natural person assigned an email address or other account by an Internet access provider, online service provider or other organization responsible for assigning email addresses or the account for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder of the email address associated with the winning entry.

  6. Selection of Winners & Prize Acceptance: Sponsor will randomly select the one (1) grand prize winner (with one associated School grand prize winner) and ten (10) secondary prizes winners (with ten [10] associated School secondary prize winners) from all eligible Entries received during the applicable Promotion Period, on or around the dates listed in Section 3 above. Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of potential winners are final and binding in all matters related to the Promotion.

    Prizes: Grand prize: One winner will receive one (1) five-hundred-dollar ($500) School Specialty Gift Card and the winner’s associated School listed on their Entry will receive one (1) room makeover using the Sponsor’s learning environments services and products of their choice (the “School Makeover Package”). Approximate Actual Retail Value (“ARV”): (i) School Specialty Gift Card: five hundred dollars ($500), (ii) School Makeover Package up to approximately fifty thousand dollars ($50,000), which is inclusive of the costs of design, price of products (valued by list price), costs of delivery, costs of installation, and all other costs borne by Sponsor to execute the makeover. The grand prizes are not cash prizes. For the absence of any doubt, the School Makeover Package is not won by the winning Entrant and is not redeemable in any way by the winning Entrant; only an eligible associated School listed on the Entry may accept and redeem the School Makeover Package.

    Secondary prize: Ten (10) winners will receive one (1) two hundred and fifty dollars ($250) School Specialty Gift Card and one (1) professional development package for the School listed on their Entry (or if unable to be used at the listed School, to an associated School, e.g. a School in the same district selected) (the “Professional Development Package”). The Professional Development Package includes up to three (3) hours of virtual or in-person professional development, provided by Sponsor, along with corresponding product to support the professional development. Approximate ARV: (i) School Specialty Gift Card: two hundred and fifty dollars ($250), (i) Professional Development Package: up to six thousand five hundred dollars ($6,500), which is inclusive of the costs of labor of providing the professional development, travel expenses, and product (valued by list price). The secondary prizes are not cash prizes. For the absence of any doubt, the Professional Development Package is not won by a winning Entrant, and is not redeemable in any way by a winning Entrant; only an eligible School may accept and redeem the Professional Development Package.

    The costs of any of products chosen for prizes will be based on current School Specialty list pricing at the time of the makeover.

    Odds of winning a Sweepstakes prize depend on the number of eligible entries received. For All Prizes: No cash equivalent and all prizes are non-transferable, and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Notwithstanding the forgoing: (i) Sponsor’s performance of the Professional Development Package prize is subject to the School’s reasonable cooperation in the provision of the prize; the School must be able to reasonably host such development (either in person-within a reasonable travel distance of a major airport, or virtually), provide more than six educators to participate in such development, and schedule the development prior to 5/31/2025; if in Sponsor’s sole discretion the School does not reasonably cooperate, the Professional Development Package will be forfeited by the School, and not re-awarded; and (i) Sponsor’s performance of the School Makeover Package is subject to the School’s reasonable cooperation in the provision of the prize; the School must make selections and otherwise provide information to Sponsor to initiate the performance and delivery of the School Makeover Package prior to 5/31/2025; if in Sponsor’s sole discretion the School is not reasonably cooperating, the School Makeover Package will be forfeited by the School, and not re-awarded. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Limit for Schools: one (1) prize per School. Limit for Entrants: one (1) gift card prize per e-mail address/Entry. Subject to the forgoing, all prizes will be awarded. No substitution, return, transfer, or cash redemption of any prize will be permitted, except that Sponsors reserve the right to substitute a prize of equal or greater value. ALL FEDERAL, STATE AND/OR LOCAL TAXES AND FEES ASSOCIATED WITH THE RECEIPT OF ANY PRIZES, INCLUDING, WITHOUT LIMITATION, ALL FEDERAL, STATE AND/OR LOCAL INCOME TAXES, ARE THE SOLE RESPONSIBILITY OF THE INDIVIDUAL WINNERS.

  7. Verification of Potential Winners: Receiving a prize is contingent upon compliance with these Official Rules. The potential Sweepstakes winners will be notified by mail, email or phone. Each potential Sweepstakes prize winner (including School winners) will be required to sign and return a Declaration of Compliance, Liability and Publicity Release which must be received by Sponsor, within five (5) days of the date notice or attempted notice is sent, in order to claim the prize. School winners must have the Declaration of Compliance, Liability and Public release signed by the authorized representatives (i.e. the School’s district). If a potential winner of any prize cannot be contacted or fails to sign and return the Declaration of Compliance, Liability and Publicity Release or provide any other requested information within the required period (if applicable), or prize is returned as undeliverable, potential winner forfeits the prize. There will be three (3) alternate drawings after which the prize will remain unawarded. Prizes will be fulfilled after the conclusion of the Promotion Period based on an agreed upon timeline with the Sponsor and winners but must be fulfilled by 5/31/2025 (or in the case of the School Makeover Package, commenced by 5/31/2025). ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES AND THE PROMOTION. AN ENTRANT (OR A SCHOOL), IS NOT A WINNER OF ANY PRIZE, EVEN IF THE SPONSOR SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S (AND IN THE CASE OF A SCHOOL WINNING A PRIZE THE SCHOOL’S) ELIGIBILITY, AND THE POTENTIAL SWEEPSTAKES WINNER (BOTH ENTRANT WINNER AND THE SCHOOL WINNER) HAVE BEEN VERIFIED AND ENTRANT (AND THE SCHOOL) HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

  8. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize. PARTICIPANT FURTHER UNDERSTAND AND AGREE THAT IF PARTICIPANT IS A RESIDENT OF CALIFORNIA, ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA ARE HEREBY EXPRESSLY WAIVED.SECTION 1542 READS AS FOLLOWS: "CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR." IF YOU ARE NOT A RESIDENT OF CALIFORNIA, YOU WAIVE ALL RIGHTS UNDER ANY LAW SIMILAR TO SECTION 1542 THAT MAY EXIST IN YOUR STATE OF RESIDENCE.

  9. Publicity: Except where prohibited, participation in the Promotion constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

  10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries or plays received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

  11. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant's entry or play is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if possible. No more than the stated number of prizes will be awarded. If production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

  12. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action and exclusively by final and binding arbitration under the rules of JAMS and held at a location mutually convenient to entrant and Sponsor located in Milwaukee, Wisconsin; and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees, or the costs of Arbitration; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
